Introduction

These Terms of Service ("Terms") govern your use of Swaygen (https://swaygen.com) and its services. Swaygen is operated by Hong Kong Nan Yao International Co., Limited, a company registered in Hong Kong ("Swaygen", "we" and "us"). By accessing or using our services, you agree to be bound by these Terms.

About Swaygen and Third-Party Models

Swaygen is an independent platform that gives you access to AI video and image models developed and operated by third parties (for example Kling, Seedance, Seedream, Wan, Nano Banana, GPT Image and FLUX) through their API services. Swaygen does not develop these models.

Swaygen is not affiliated with, endorsed by, or sponsored by ByteDance, Alibaba, Google, Kuaishou, OpenAI, Black Forest Labs or any other model provider. Model names and trademarks belong to their respective owners and are used only to identify the models available on Swaygen. The list of available models, their capabilities and their credit costs may change over time; the current information is always shown in each tool before you generate.

Accounts

You must provide accurate information when you create an account and keep your sign-in credentials secure. You are responsible for all activity under your account. You must be at least 18 years old, or the age of majority where you live, to purchase a paid plan.

Subscriptions, Credits and Billing

Paid plans are billed in advance, monthly or yearly, through our payment processor Stripe. The price, currency and billing interval are shown on the pricing page and on the checkout page before you pay.
Subscriptions renew automatically at the end of each billing period at the then-current price for your plan until you cancel. We will tell you in advance by email if the price of your plan changes.
You can cancel at any time from Settings → Billing. Cancellation stops the next renewal; you keep access and your remaining plan credits until the end of the period you have already paid for.
Credit packs are one-time payments and do not renew.
Credits are usage units for generating content. They have no cash value, cannot be transferred or exchanged for money, and expire as described in our Refund Policy. The credit cost of each generation is shown before you start it. If a generation fails, its credits are returned automatically.
Refunds are handled according to our Refund Policy.

Generated Content and Commercial Use

Subject to these Terms and the terms of the underlying model provider, you own the content you generate on Swaygen.
Content generated on a paid plan may be used for commercial purposes and is downloaded without a watermark. Content generated on the free plan includes a watermark.
You are responsible for your prompts and uploads and for how you use the generated content. You must have the rights to anything you upload and must not use Swaygen to infringe the intellectual property, privacy or publicity rights of others.
AI output can be inaccurate or unexpected. Review generated content before you rely on or publish it.

Your Uploads

You keep all rights to the images, videos, audio and text you upload. You grant us a limited licence to store and process them, and to send them to the model provider you select, only as needed to provide the service to you.

Acceptable Use

Your use of Swaygen must follow our Acceptable Use Policy and Content Moderation Policy. In particular, you must not:

use the service in a way that violates any applicable law or regulation;
create sexual content involving minors, non-consensual intimate imagery, or content that harasses or defames real people;
impersonate others or create deceptive content intended to mislead people;
attempt to gain unauthorised access to our systems, or interfere with the service or other users.

Suspension and Termination

We may suspend or close an account that breaches these Terms. You can delete your account at any time from Settings → Security.

Service Availability

We work to keep Swaygen available and accurate, but the service is provided "as is" and "as available". Third-party model providers may change, limit or discontinue their models, which may affect the models available on Swaygen.

Limitation of Liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages arising from your use of, or inability to use, the service. Nothing in these Terms limits any rights you have under the consumer protection laws of your country.

Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and change the date above. For material changes we will notify registered users by email.
